Notice of Nonreappointment

Obtaining Notice Form

The Notice of Nonreappointment form is a multi-part NCR form available from the Human Resources Department. Please contact the appropriate Vice President's Office to alert them of your need for the form. Each Vice President's office will contact Hilary Bockstanz or Sam Connally in Human Resources to obtain the form. If you currently have forms in your possession we ask that you send these forms to Human Resources at mailsort 1026. The current version of the form is dated "(02-98)" and only this form is to be used. Previous versions of the form should be destroyed.

Minimum Notice Dates

We ask that you contact Hilary Bockstanz (895-0503) to confirm the date by which notice must be given to an employee.

Per the UCCSN Code, the amount of minimum notice that must be given depends upon the length of time the employee has been under contract. Per the UCCSN Code, each contract period ends on June 30 and a comparison of the initial start of the employment of the individual to this date will determine the amount of notice necessary. In the first contract that ends June 30, notice would need to be given on or before March 01. In the second contract that ends June 30, notice would need to be given on or before December 15. With respect to the third contract that ends June 30, notice would need to be given one year in advance.

While on the surface these dates may seem straight-forward, we still ask that you call to confirm the date with Human Resources.

Preparation of Notice Form

Please remember that the form must be completely signed at each step up through the UNLV President prior to it being presented to the employee.

Presentation of Notice Form to Employee

Whenever possible, it is suggested that the form be given in person to the employee.

If the notification is done via the mail, Delivery Confirmation is to be obtained. The US Postal Service offers Delivery Confirmation at a nominal fee. Learn more about this confirmation method through the USPS website, the address is www.usps.com/shipping/deliveryconfirm.htm.

Disposition of Form after Presentation to Employee

The executed form should be sent to the attention of Hilary Bockstanz in Human Resources at mailsort 1026 for copy distribution and filing.

  • Notice of Nonreappointment - for employees on A or B contract hired before March 1, 2005 only
  • Notice of Termination - for employees on A contract hired on or after March 1, 2005 only
  • Notice of Termination - for employees on B contract hired on or after March 1, 2005 only

    Annual Leave Usage or Payment

    Annual leave for a notice of nonreappointment contract cannot be used after the contract end date on June 30th. As such, the employee needs to be paid for unused leave on their final check in June or have used their leave before that date. Employees will be paid unless you direct, in writing, the employee to use their leave per Title 4, Chapter 3, Section 13.5 of the Board of Regents Handbook.

    Renewal Letters and EDOC Preparation

    In cases where an employee has been issued a Notice of Nonreappointment, an Employment Document is to be completed in lieu of use of a contract renewal letter. When practical, the verification roster entry for that employee should be marked as "EDOC Needed." If a contract renewal letter is generated, it should be returned to the Human Resources Office. In these nonreappoinment situations, the language on the renewal letter is not appropriate. Each renewal letter states that "all other terms and conditions of employment on your last previously signed written contract remain if effect." For employees that have received the Notice of Nonreappointment, this language is clearly problematic. As such, the following EDOC procedures are to be followed:

    An employment document with an action code of 09 (Job Assignment Change / Reappointment) should be prepared and the "remarks" section of the employment document should read:

    "This contract will not be renewed after ________ (enter date the job will terminate) as per Notice of Nonreappointment dated ________ (enter date the notice of non-reappointment was issued)."

    Final Separation and EDOC Preparation

    A final or separation EDOC is used as the vehicle to communicate what day to stop payment of wages and to notify the benefits area to the fact that an employee is leaving a benefit eligible status. It also informs the appointee as to the last day of their appointment.

    An employment document with an action code of 05 (Separation) should be prepared and the "remarks" section of the employment document should read:

    "Separation per Notice of Nonreappointment dated _______ (enter date the original notice was issued)."

    If the employee was on an "A" contract, any accrued annual leave must be listed in the "remarks" section and paid to the employee.
